GST appeals were rejected as time-barred under Section 107 although the delay was only about thirteen to fourteen days. The Madras High Court directed the appellate authority to receive and dispose of the appeals on merits subject to satisfaction that the pre-deposit requirement was met, and accepted that amounts already appropriated from the electronic cash ledger could count towards that deposit.
What to do about it: A short delay in filing an appeal is usually curable, and money already recovered from your ledger can be treated as part of the pre-deposit.
