Circular No. 157/13/2021-GST dated 20 July 2021 · 2021-07-20

CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.

A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
What are the conditions under Section 16 I must satisfy before claiming any input tax credit?
Section 16(2) prescribes cumulative conditions: you must hold a valid tax invoice or debit note, you must have actually received the goods or services, the supplier must have paid the tax to the government, and you must have filed your GSTR-3B. Added to these, the invoice must appear in your GSTR-2B and must not be restricted there. In practice this means a genuine purchase can still fail the test if your supplier defaults. Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming.
