Further clarifications on warranty replacements and extended warranty

Circular No. 216/10/2024-GST · 2024-06-26

This circular amends and supplements the earlier warranty circular. It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.

Practical effect: Chennai dealers who swap out an entire defective product under warranty are now expressly covered, so no output tax or credit reversal is required.

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. How do I claim credit of the IGST paid on imported goods?
IGST paid at customs on imported goods is fully creditable, with the bill of entry serving as the prescribed duty-paying document instead of a tax invoice. The data flows from ICEGATE into your GSTR-2B, and the claim is made in Table 4(A)(1) of GSTR-3B. If a bill of entry does not appear, use the search BoE facility on the GST portal to fetch the record before assuming it is missing. Remember that basic customs duty and the social welfare surcharge are never creditable; only the IGST and compensation cess components are. Importers in Peravallur should reconcile their ICEGATE ledger with GSTR-2B quarterly, because clearance-date mismatches are frequent.

When renewing policies, check that the insurer has passed on the exemption rather than merely repricing the premium.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
What is the difference between a GST credit note and a commercial credit note?
