A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
I agree with part of the ASMT-10 discrepancy but not all of it. How do I respond?
A split response is perfectly acceptable and often the wisest course. Pay the portion you accept through Form DRC-03 with interest at 18 percent per annum, and in your ASMT-11 reply state the payment details along with a reasoned explanation for the balance, supported by reconciliations, invoices and ledger extracts. Paying the admitted amount voluntarily at the scrutiny stage avoids penalty on it under Section 73 and shows bona fides, which helps the officer accept your explanation on the disputed part. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Perungudi use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
