The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
Practical effect: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.

The Supreme Court upheld the levy of GST on lotteries, holding that the inclusion of actionable claims such as lottery, betting and gambling within the definition of 'goods' under Section 2(52) CGST Act is constitutionally valid and not discriminatory. It further held that GST is payable on the face value of lottery tickets, including the prize money component, rejecting the argument that prize money should be excluded from the taxable value.

Notification No. 34/2023-Central Tax · 2023-07-31
With effect from 1 October 2023, persons making only intra-State supplies of goods through e-commerce operators were exempted from mandatory GST registration if their aggregate turnover stays within the threshold limit. Conditions include obtaining an enrolment number on the portal using PAN, operating in a single State or Union Territory, declaring the enrolment number to the platform, and not making inter-State supplies. Earlier, any online sale of goods forced immediate registration.
Why this matters: A small Chennai seller can now list goods on online marketplaces for Tamil Nadu customers without a GSTIN, provided they take the portal enrolment number and stay intra-State.
