Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

Practical effect: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

Co-owners had let a residential building to a company that ran it as a hostel for students and working professionals. The advance ruling authorities denied exemption on the view that the lessee was using the property commercially. The High Court disagreed and held that leasing residential premises used as a hostel falls within Entry 13 of the IGST services exemption notification, since that entry does not require the lessee itself to occupy the premises as a residence. The Supreme Court dismissed the State's appeals on 4 December 2025 and confirmed that the end use as a residence, not the intermediate commercial layer, decides the question.

Practical effect: Chennai property owners letting buildings to hostel operators now have Supreme Court backing for periods before 18 July 2022, though later periods must also account for the registered-tenant reverse charge.

Circular No. 17/17/2017-GST dated 15 November 2017 · 2017-11-15

Because the refund module was not available on the common portal, CBIC directed that refund claims relating to zero-rated supplies be filed and processed manually. The applicant generated FORM GST RFD-01A online, printed it and submitted it with supporting documents to the jurisdictional office, which issued acknowledgement in RFD-02, a deficiency memo where needed in RFD-03, the provisional refund order in RFD-04 and the final sanction or rejection order in RFD-06. Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point.
