GSTN Advisory dated 23 August 2024 — Rule 10A bank account furnishing · 2024-08-23

GSTN advised that under Rule 10A of the CGST Rules, registered taxpayers must furnish valid bank account details within 30 days of registration or before filing GSTR-1 or IFF, whichever is earlier. From 1 September 2024 the portal blocks GSTR-1 and IFF filing for taxpayers whose bank account details are not available and validated on the portal. The measure targets fraudulent registrations created without genuine banking trails.

Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.

If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state. Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
My supplier filed GSTR-1 but never filed GSTR-3B. Does that affect my credit?
Yes, through Rule 37A. If your supplier reports the invoice in GSTR-1, the credit flows into your GSTR-2B and you may claim it, but if that supplier has not filed the GSTR-3B for the same period by 30 September following the end of the financial year, you must reverse the credit in a return filed on or before 30 November. Reversal done within this window carries no interest; delay beyond it attracts interest at 18 percent. The credit can be re-availed once the supplier eventually files GSTR-3B. A supplier filing-status check is therefore now part of any serious reconciliation for businesses in Ponneri.
Who has to file the GSTR-9 annual return?

Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. How do I document free samples and gifts given to customers?
Goods supplied genuinely free of cost to unrelated persons are not a supply, so no tax invoice is raised and no GST is charged; the movement is covered by a delivery challan marked as free samples.
