The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.

It also clarified that where a hospital engages senior consultants and retains a share of their fees, the entire consideration charged to the patient is exempt healthcare service. Separately it dealt with hostel accommodation below the then exemption threshold.
