The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.
Why this matters: A Chennai business should diarise the date of any Section 83 attachment — after twelve months the bank must release the account, and a fresh order is required if the department wants to continue.

The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. Where a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code and the government's claim is scaled down, the tax department cannot continue to pursue the original demand. The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.
What to do about it: If a Chennai company has come out of insolvency, insist on a DRC-25 intimation so that the old demand stops appearing in the recovery register and blocking registration or refunds.
