The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.

Practical effect: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
How is interest calculated if I pay GST late?
Interest is charged at 18 percent per annum under Section 50 of the CGST Act, calculated day-wise from the due date until the date of payment. Following the amendment to Section 50, interest on delayed GSTR-3B filing applies only on the portion of tax paid through the electronic cash ledger, not on the amount settled using input tax credit. My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?

Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. First, where you use catering as an input for making an outward supply of the same category, such as a caterer subcontracting another caterer, credit is allowed. Second, where providing the facility is obligatory for the employer under any law, credit is allowed; the classic case is a statutory canteen required under the Factories Act for factories employing more than 250 workers. Even then, credit is typically restricted to the cost borne by the employer, not amounts recovered from employees. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies.
