3rd GST Council Meeting, New Delhi — 18-19 October 2016 (Signed Minutes, Agenda Item 2) · 2016-10-18

The Chairperson offered a compromise between a fixed 13 per cent growth rate, an average of three of the preceding five years' growth after removing the highest and lowest, and a 14 per cent rate pressed by Kerala and Assam. The Council unanimously agreed that projected State revenue for compensation purposes would grow at a flat 14 per cent per year from the 2015-16 base, with CST in that base counted at the actual 2 per cent. This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.

Practical effect: The 14 per cent guarantee is the reason compensation cess outlived its original five-year sunset, so cess-bearing goods remain costlier than the headline GST rate suggests.

Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24

This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. Errors in GSTR-1 can be amended in the following period's return. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
My turnover is Rs.1.2 crore. Is GSTR-9 compulsory for me?
No. For taxpayers with aggregate turnover up to Rs.2 crore, filing GSTR-9 has been made optional through CBIC notifications, and this relaxation has been continued year on year. If you do not file by the due date, the return is deemed furnished. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate.
