This notification waived the late fee under section 47 for registered persons who failed to furnish FORM GSTR-1 for the months or quarters from July 2017 to September 2018 by the due date, provided the pending returns were furnished between 22 December 2018 and 31 March 2019. For online services supplied to unregistered persons, including OIDAR services, online gaming and subscriptions, CBIC clarified that the supplier must record the recipient's State on the tax invoice, which is then deemed the address on record for determining place of supply under Section 12(2)(b). Failure to collect and record the State means incorrect place of supply, wrong apportionment of tax between States, and exposure to penal action under Section 122(3)(e).
What it means for you: Any business selling digital services or subscriptions to consumers must capture the customer's State at checkout and print it on invoices, or face penalties and tax reallocation disputes.

Owing to a mistake, the company's GSTR-3B for one month was filed showing nil figures even though the tax had actually been paid, and the portal offered no way to correct it. The department refused rectification. The High Court held that a taxpayer cannot be left without a remedy for a bona fide error where the tax was in fact paid and no revenue was lost, and directed the authorities to allow the correction so that the liability and the recipient's credit were properly reflected.
Why this matters: A genuine reporting error in GSTR-3B is worth pressing before the department rather than absorbing — courts have ordered correction where no tax was actually short paid.
