Paschimanchal Vidyut Vitran Nigam Ltd v. Raman Ispat (P) Ltd — Supreme Court, judgment dated 17-07-2023 · 2023-07-17
The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.
