The state GST authority, the central preventive branch and the Directorate General of GST Intelligence all initiated action against the same taxpayer for the same period. The High Court held that subjecting a taxpayer to three simultaneous investigations amounts to harassment. The authority that first initiated proceedings should continue and conclude them, and the other authorities were directed to transfer their material to that authority instead of running independent inquiries.

Notification No. 11/2025-Central Tax · 2025-03-27
CBIC amended Rule 164 to resolve a practical roadblock in the Section 128A scheme. Where a single notice or order spans FY 2017-18 to 2019-20 as well as periods outside the scheme, the taxpayer may pay the tax attributable only to the covered period and need not withdraw the whole appeal, a new proviso permitting partial withdrawal limited to the covered period while the appeal continues for the balance. The amendment also confirms that no refund arises for tax, interest or penalty already discharged for the entire period.
Why this matters: A demand order mixing amnesty-eligible and other years no longer forces an all-or-nothing choice; the waiver can be taken for 2017-20 while litigating the rest.
GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.
Practical effect: If you settled 2017-20 demands under the amnesty, preserve the SPL filings and payment proofs; if you missed it, factor full interest into dispute strategy.
