The taxpayer had reported credit under the wrong heads in GSTR-3B, showing IGST instead of CGST and SGST, although the total credit taken matched the tax actually borne on purchases. A demand was raised for wrongly availed credit. The Division Bench held that a clerical and revenue-neutral error in classifying credit between heads does not amount to wrong availment attracting demand and interest, and the demand raised only on that ground could not be sustained.

Why this matters: If a notice alleges excess credit only because the IGST and CGST/SGST columns were swapped, show that the total credit matches your purchase register — the error is correctable.

Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

This notification lists the services that are wholly exempt from CGST. It covers charitable activities, most services supplied by and to Government, renting of residential dwellings for use as residence, healthcare by a clinical establishment, education by an educational institution, agricultural services, several transport exemptions and financial services such as interest on deposits and loans. Each entry has a description, a service code and often a condition. An exemption is not a zero rate: input tax credit attributable to exempt supplies has to be reversed.

The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
I applied for GST registration in Saligramam and received a REG-03 notice. What does it mean?

Courts take cognizance only with the Commissioner's previous sanction.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
What is a GST health check and does my business really need one?
A GST health check is a preventive review of your compliance before the department finds the gaps.
