Budget hotel rooms taxed and costly hospital rooms brought to 5 per cent

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.

Practical effect: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.

Electronic toys attract 18 percent while other toys stay at 12 percent

The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

What it means for you: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.

What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
My GST status shows suspended. What does that mean for my business in Sembium?

For monthly filers: GSTR-1 by the 11th and GSTR-3B by the 20th of the next month. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter.
