Student recruitment for foreign universities held to be intermediary service, not export

Global Reach Education Services Pvt Ltd — AAR West Bengal, ruling dated 21 March 2018, upheld by AAAR West Bengal, Order No. 01/WBAAAR/Appeal/2018, dated 24 July 2018 · 2018-03-21

The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.

Practical effect: Businesses earning foreign commission for facilitating a third party's supply should test the intermediary risk before treating receipts as zero-rated exports.

Liquidated damages, notice pay and contractual penalties are generally outside GST

Circular No. 178/10/2022-GST · 2022-08-03

This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. I export goods after paying IGST. How do I get that tax back?
For export of goods with payment of IGST, no separate RFD-01 is needed. The shipping bill filed with customs is itself treated as the refund application once you file GSTR-1 with correct shipping bill details in Table 6A and pay the tax through GSTR-3B. Customs matches the data from the GST portal with ICEGATE and credits the refund directly to your bank account. Most delays happen because of invoice mismatches between GSTR-1 and the shipping bill, or bank account validation errors, so reconcile both before filing each month.
What is the time limit for filing a GST refund application?
Form RFD-01 must be filed within two years from the relevant date defined in Section 54 of the CGST Act. For export of goods, the relevant date is the date the ship or aircraft leaves India; for export of services, it is the date of receipt of foreign exchange or the invoice date, whichever is later; for inverted duty structure, it is the due date of the return for the period in which the claim arises. I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?
Under Section 50(3) as amended, interest at 18 percent per annum applies where wrongly availed credit has also been utilised, calculated from the date of utilisation until reversal; credit that was availed but never utilised, because your ledger balance never fell below the wrong amount, attracts no interest. What is the difference between a GST practitioner and a GST consultant?
A GST practitioner is a person formally enrolled with the department under Section 48 and Rule 83, through an application in Form PCT-01 and an enrolment certificate in PCT-02, after meeting qualification norms and clearing the NACIN examination where applicable. Once you authorise a GSTP on the portal, they can prepare and furnish your returns, deposit challans and file refund or registration applications on your behalf, with each activity visible in your account. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. What are OIDAR services under GST and who pays the tax on them?

My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital.
