Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

Practical effect: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

At what amount of tax evasion can GST prosecution be launched?

Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Semmancheri as urgent.

Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate.
