The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

The taxpayer argued that because credit was sitting in its electronic credit ledger, no interest should arise on delayed returns. The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.
Practical effect: Sitting on an unused credit balance is no defence to interest — the return must actually be filed and the credit debited for the liability to be treated as discharged.

Where an Indian entity receives services from a related foreign affiliate and is liable to pay tax under reverse charge, CBIC clarified that if the Indian entity is eligible for full input tax credit, the value declared on the self-invoice is deemed to be the open market value. Where the foreign affiliate raises no invoice for the service, the value may be treated as nil, and that nil value is deemed the open market value. No demand can then be raised on a notional cost allocation.
Why this matters: Indian subsidiaries receiving unbilled support from an overseas parent can self-invoice at nil value where full credit is available, closing a common audit objection.
