It held that salary received as an executive, full-time director is outside the ambit of GST and not includable in aggregate turnover. In contrast, remuneration of a non-executive director is a taxable service, and such amounts, along with partner's salary from a firm, interest income and rental income — including residential rent that is itself exempt — must be counted when testing the registration threshold.

The CGST (Second Amendment) Rules, 2023 inserted Rule 88D, under which the portal auto-intimates a taxpayer in Form DRC-01C when ITC claimed in GSTR-3B exceeds that available in GSTR-2B beyond the prescribed limit. The taxpayer must pay the difference or explain it within seven days, failing which the next GSTR-1 is blocked. The rules also tightened Rule 10A, requiring bank account details within thirty days of registration or before filing GSTR-1, with suspension for default.

A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.
