Invoking Section 168A once more, CBIC extended compliances whose due dates fell between 15 April 2021 and 29 June 2021 to 30 June 2021. The first notification of 1 May 2021 set the outer date at 31 May 2021 and the second of 1 June 2021 moved it to 30 June 2021. The relief covered completion of proceedings, passing of orders, issue of notices, filing of appeals, replies and applications, but excluded return filing and tax payment which were dealt with separately.

Practical effect: Any appeal, reply or refund application that fell due during the second wave gets the benefit of this extension, which is worth checking before conceding that a claim is time-barred.

28 per cent GST on online gaming, casinos and horse racing at full face value

50th GST Council Meeting, New Delhi — 11 July 2023 · 2023-07-11

The 50th GST Council meeting decided that online gaming, casinos and horse racing would be taxed at 28 per cent on the full face value of bets or chips purchased, without distinguishing games of skill from games of chance. The Council recommended amending the GST laws to include online gaming and horse racing as taxable actionable claims. The decision reshaped the economics of the online real-money gaming industry and triggered large retrospective demand notices on gaming companies.

Practical effect: Any Chennai business operating or facilitating real-money games must register, charge 28 per cent on deposits and expect close departmental scrutiny of past periods.

Agricultural seedling trays are plastic articles taxable at 18 percent

Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

What to do about it: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. Once the return is filed within this window, no further action follows. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for T. Nagar businesses, since no appeal is provided against DRC-22. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Track every submission with an acknowledgment, because the commencement date and the timeline arguments may matter later if disputes arise.
The audit team has pointed out a tax liability. Should I pay it or contest it?
Evaluate each para on its own merits. For findings that are clearly correct, such as missed reverse charge or arithmetic ITC excess, paying through DRC-03 with interest before a show cause notice is issued avoids penalty under Section 73 and closes the para. For findings based on debatable classification, valuation or ITC interpretation, submit a reasoned rebuttal to the draft observations, because accepting them sets a precedent for future years. What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Litigation-heavy businesses in T. Nagar should reconcile their legal expense ledger against RCM paid every quarter.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
