The GST Appellate Tribunal's e-filing portal at efiling.gstat.gov.in became operational on 24 September 2025, finally giving taxpayers a forum for second appeals against orders of appellate and revisional authorities. Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.
Practical effect: List every unfavourable appellate order your business holds and calendar the GSTAT filing windows now, since the backlog window closes on 30 June 2026 and missed tribunal deadlines forfeit the appeal remedy.
Notification No. 16/2021-Central Tax · 2021-06-01
This notification brought into force Section 112 of the Finance Act, 2021, which substituted the proviso to Section 50(1) of the CGST Act with retrospective effect from 1 July 2017. The result is that interest on late payment of tax through a delayed GSTR-3B is chargeable only on the portion discharged in cash, for all periods from the inception of GST, and not merely from September 2020. This ended the large body of litigation over gross-liability interest demands.
What to do about it: Every interest demand computed on gross liability for any period since July 2017 is unsustainable, and this is one of the most useful notifications to cite in a Chennai interest dispute.

Goods in transit were detained and the trader paid the penalty demanded under Section 129 in order to get the consignment released, while also filing written objections. The department treated the matter as closed. The Supreme Court held that payment made under commercial compulsion is not a voluntary admission, and that where objections are on record the officer must still pass a reasoned speaking order in Form GST MOV-09. Without such an order the statutory right of appeal becomes illusory.
What it means for you: If a Chennai trader or transporter pays an e-way bill penalty only to release detained goods, record a written protest and objection at once and insist on a speaking order so that the appeal route stays open.
