Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.
What to do about it: Chennai employers and contractors should resist departmental demands on notice pay recovery and liquidated damages by citing this circular in the reply itself.
Notification No. 3/2025-Compensation Cess (Rate), dated 31 December 2025 · 2025-12-31
Issued with the tobacco rate notification, this reduces the compensation cess rate to nil on pan masala, tobacco and the related products that had continued to bear cess after September 2025, with effect from 1 February 2026. Since the goods simultaneously moved to the forty per cent GST rate, the combined burden is broadly preserved while the cess itself is retired, bringing the compensation cess levy introduced in July 2017 to an end for practical purposes.
What to do about it: From 1 February 2026 no compensation cess is charged on any goods, so cess columns in invoices, returns and accounting software should be closed out.

The assessment orders had denied input tax credit purely because the returns were filed after the Section 16(4) cut-off. The Court held that the challenge was squarely covered by newly inserted Section 16(5), which permits credit on invoices relating to the financial years 2017-18 to 2020-21 if taken in any return filed up to 30 November 2021, notwithstanding Section 16(4). The impugned orders were quashed and the matter remitted for fresh orders consistent with the amendment.
What it means for you: A Chennai dealer whose ITC for 2017-18 to 2020-21 was disallowed only for late filing should apply for rectification or move the High Court, since Section 16(5) now protects that credit.
