Such manufacturers must declare details of every packing machine, its make, capacity and installation address, in Form GST SRM-I within the prescribed time, report any addition or removal of machines, and file a monthly statement of inputs and outputs in Form GST SRM-II. The procedure took effect from 1 April 2024 and carries a separate penalty for unregistered machines.

Practical effect: Any Chennai unit packing tobacco or pan masala products must register every machine in SRM-I and file SRM-II monthly, entirely separate from its normal GST returns.

The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
The audit team has pointed out a tax liability. Should I pay it or contest it?
Evaluate each para on its own merits. For findings that are clearly correct, such as missed reverse charge or arithmetic ITC excess, paying through DRC-03 with interest before a show cause notice is issued avoids penalty under Section 73 and closes the para. For findings based on debatable classification, valuation or ITC interpretation, submit a reasoned rebuttal to the draft observations, because accepting them sets a precedent for future years.
