GSTN Advisory, November 2024 — Form GST DRC-03A functionality on the portal (Rule 142(2B) and Notification No. 12/2024-Central Tax, dated 10 July 2024) · 2024-11

Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.

What it means for you: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.

Ancillary services of an electricity distributor held exempt; circular paragraph struck down

Torrent Power Ltd v. Union of India — Gujarat High Court, R/Special Civil Application No. 5343 of 2018, judgment dated 19 December 2018 · 2018-12-19

Circular No. 34/8/2018-GST had stated that services such as meter rent, application fees and shifting of lines supplied by an electricity distribution utility are taxable separately. The High Court struck down paragraph 4(1) of that circular, holding that these services are naturally bundled with the exempt supply of transmission and distribution of electricity and therefore take the character of the principal exempt supply. A circular cannot narrow the scope of an exemption notification.

Registered persons whose aggregate turnover in the financial year 2019-20 was up to Rs 2 crore were given the option not to file the annual return in Form GSTR-9. If such a person did not file by the due date, the return would be deemed to have been furnished on the due date. The same relief had been given for 2017-18 and 2018-19, and it was renewed in similar terms for the following years, making it a settled feature of the annual return regime.

Practical effect: Most Chennai small traders and service providers need not file GSTR-9 at all, and a notice demanding it from a sub-Rs 2 crore taxpayer should be answered by citing this exemption.

How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for T. Nagar businesses, since no appeal is provided against DRC-22. What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. I received an ASMT-10 scrutiny notice for my T. Nagar business. What exactly is it?
ASMT-10 is a notice issued under Section 61 after the officer scrutinises your filed returns and finds discrepancies, such as differences between GSTR-1 and GSTR-3B, excess ITC compared with GSTR-2B, or turnover gaps against e-way bill data. It is not yet a demand; it is an opportunity to explain. What is the difference between a Section 73 and a Section 74 notice?

You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Litigation-heavy businesses in T. Nagar should reconcile their legal expense ledger against RCM paid every quarter.
What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. Yes. Renting of commercial property such as shops, offices, godowns and industrial sheds is a taxable supply of services at 18 percent, charged by the landlord under forward charge once the landlord's aggregate turnover, including this rent, crosses Rs.20 lakh. The tenant, if registered and using the premises for business, can claim the GST as input tax credit, since renting is not a blocked credit. Landlords with several small commercial properties often cross the threshold without realising it, because rent from all properties on the same PAN is clubbed. Is there really a penalty for not displaying my GST number at my shop?
Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty.
