This notification waived the late fee under section 47 for registered persons who failed to furnish FORM GSTR-1 for the months or quarters from July 2017 to September 2018 by the due date, provided the pending returns were furnished between 22 December 2018 and 31 March 2019. It was an amnesty aimed at bringing dormant and defaulting registrations back into the return filing system.

The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.
What to do about it: If you collect late payment penalties from customers, check whether the charge sits inside the main contract before deciding to levy GST on it.
CBIC Instruction No. 03/2025-GST · 2025-04-17
Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.
