Circular

Standard procedure for processing a voluntary cancellation application

Circular No. 69/43/2018-GST dated 26 October 2018 · 2018-10-26

This circular set out how officers must handle an application for cancellation of registration in FORM GST REG-16. The officer should verify the application and, if satisfied, pass the cancellation order in FORM GST REG-19 within thirty days. Pending returns are to be filed and any liability discharged, and the taxpayer must file the final return in FORM GSTR-10 within three months of the cancellation order. Cancellation cannot be refused merely because dues are outstanding.

Late fee ceilings rationalised for GSTR-1, GSTR-4 and GSTR-7

Notification No. 20/2021-Central Tax, Notification No. 21/2021-Central Tax and Notification No. 22/2021-Central Tax · 2021-06-01

Three companion notifications rebuilt the late fee structure on a turnover basis from June 2021. For GSTR-1 the fee was capped at Rs 500 for nil statements, Rs 2,000 where turnover is up to Rs 1.5 crore and Rs 5,000 where turnover is between Rs 1.5 crore and Rs 5 crore, with the normal Rs 10,000 ceiling continuing above Rs 5 crore. For the composition annual return in GSTR-4, from the financial year 2021-22 onwards, the fee was capped at Rs 2,000 in total, being Rs 1,000 each under the central and State laws, and at Rs 500 in total where the return is nil. For the tax deduction return in GSTR-7 the fee was reduced to Rs 50 per day subject to a ceiling of Rs 2,000.

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.

In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. Yes, through Rule 37A. If your supplier reports the invoice in GSTR-1, the credit flows into your GSTR-2B and you may claim it, but if that supplier has not filed the GSTR-3B for the same period by 30 September following the end of the financial year, you must reverse the credit in a return filed on or before 30 November. Reversal done within this window carries no interest; delay beyond it attracts interest at 18 percent. The credit can be re-availed once the supplier eventually files GSTR-3B. What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A T. Nagar trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. Apparel, made-up textile articles and footwear with a sale value up to Rs.2,500 per piece attract 5 percent GST, while pieces priced above Rs.2,500 attract 18 percent. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered T. Nagar manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. This rule matters chiefly for paying reverse charge on GTA freight under the correct heads, because paying IGST where CGST and SGST were due creates a refund-and-repay exercise later.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
