The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.

Following the 55th GST Council meeting, fortified rice kernel classifiable under heading 1904 was placed at five per cent irrespective of end use, removing the earlier distinction based on whether it was supplied for public distribution. The same notification recast the definition of pre-packaged and labelled so that it clearly covers commodities intended for retail sale in packs of not more than twenty-five kilograms or twenty-five litres that must bear declarations under the Legal Metrology Act, 2009.

Centre-State division of taxpayers settled at 90:10 below Rs 1.5 crore

The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.

What is the difference between CPIN and CIN, and how long is a GST challan valid?

When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
Do I have to report HSN codes in my GSTR-1?
Yes. Taxpayers with aggregate turnover up to Rs.5 crore must report a 4-digit HSN summary for B2B supplies in Table 12 of GSTR-1, while those above Rs.5 crore must report 6-digit HSN codes for all supplies. The portal now validates HSN entries against its master list, so wrong or truncated codes can block filing. What is GSTR-2B and why does my consultant match it before filing?

Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a T. Nagar seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent.
