CBIC clarified that the words subsequently held in section 77 of the CGST Act and section 19 of the IGST Act cover both a case where the department holds a supply to be inter-State or intra-State and a case where the taxpayer himself realises the error, provided the correct tax is then paid. Under rule 89(1A), the refund of the wrongly paid tax must be claimed within two years of paying tax under the correct head, and for payments made before 24 September 2021 the period runs from that date.
Why this matters: If you have paid CGST and SGST on what was actually an inter-State supply, pay the IGST first and then claim the refund within two years, with no interest liability under section 77.

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.
Why this matters: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.
