The Supreme Court held that for invoking the extended period of limitation, suppression must be wilful. It means a deliberate act of withholding information which the assessee knew he was obliged to disclose. Where facts were within the department's knowledge, or the assessee acted on a bona fide understanding, the charge of suppression fails. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.
