Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

Podaran Foods India (P) Ltd v. State of Kerala — Kerala High Court, 2021 · 2021-01-12
Examining a series of detentions of goods in transit, the Kerala High Court held that the power under Section 129 cannot be exercised mechanically for every discrepancy; detention is justified only where the defect in documents or transport points to a contravention of the GST law, and officers must pass reasoned orders within statutory timelines. The Court set out the procedure to be followed, discouraging detention for trivial or bona fide errors that carry no revenue implication.
Why this matters: When a vehicle is stopped, demand a reasoned detention order and match the alleged defect against actual legal requirements — trivial documentation slips do not justify Section 129 penalties.
Circular No. 171/03/2022-GST · 2022-07-06
The Board explained how demand and penalty apply where invoices are issued without any actual supply. A person who merely issues such an invoice has no output tax liability under Sections 73 or 74, because there is no supply at all, but is liable to penalty under Section 122(1)(ii). A person who takes and utilises credit on such an invoice faces demand and penalty under Section 74, and a person who further passes on that credit is treated the same way.
What to do about it: If your Chennai firm is alleged to have issued bill-only invoices, this circular is the basis for arguing that a tax demand cannot be raised on the issuer, only a penalty.
