The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

Compensation cess on cigarettes raised to restore pre-GST tax incidence

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

Practical effect: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
When is GSTR-1 due for my business in Thirusulam?

For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
What is the QRMP scheme and can my business opt for it?
QRMP stands for Quarterly Return filing and Monthly Payment. Taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year can opt in. Under the scheme you file GSTR-1 and GSTR-3B once a quarter instead of every month, but you still pay tax monthly through challan PMT-06 for the first two months of the quarter. Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
Is GST payable on hostel or paying guest accommodation in Thirusulam?

What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. Most professional, business support and repair services billed by professional firms continue at 18 percent with full input tax credit.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
