The Council recommended nil GST on food preparation of millet flour in powder form containing at least 70 per cent millets by weight when sold loose, and 5 per cent when pre-packaged and labelled. GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.

Practical effect: Food processors and cattle-feed traders in Tamil Nadu gained significant input cost relief and needed to re-price millet-based products.

Notification No. 12/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

The old and used motor vehicle notification of January 2018 referred to Schedule IV of the 2017 rate notification to identify the vehicles it covered. Since that notification was superseded, this amendment substitutes a reference to Schedule II or Schedule III of the new goods rate notification with effect from 22 September 2025. The margin-based valuation and the bar on having availed input tax credit continue exactly as before; only the cross-reference changes.

Practical effect: Second-hand vehicle dealers need not change their computation method, but should quote the corrected notification reference in invoices and replies to officers.

Claiming it earlier is a premature availment that can be flagged in scrutiny. Is ITC available on food, catering and canteen expenses for our factory staff?

It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction.
