Trade Profile and GST Jurisdiction for Eshwaran Koil Street, Thoraipakkam

Thoraipakkam sits where Rajiv Gandhi Salai meets the Pallavaram - Thoraipakkam Road, and its frontage carries IT offices, coworking spaces, car showrooms, cloud kitchens, furniture and hardware dealers, plus paying-guest hostels serving Secretariat Colony and Kumaran Kudil. Restaurant chains on the OMR service road and promoters in the interior streets struggle with e-invoicing thresholds, blocked credit on restaurant supply and monthly GSTR-3B reconciliation against GSTR-2B. When businesses of this kind evaluate GST Notice Reply, the real question is not price alone but who answers when something goes wrong. We serve Thoraipakkam, Perungudi and Karapakkam on a standing commitment: responses within the same working day, senior scrutiny before every submission, and continued support if the department ever writes back on work carrying our preparation.

GST jurisdiction for Thoraipakkam (PIN 600097): businesses here generally fall under the CGST Chennai South Commissionerate. We regularly represent clients from Thoraipakkam before this jurisdiction for registrations, clarifications and notice hearings, and can confirm your exact division and range from your GSTIN. State-jurisdiction cases are handled with the Tamil Nadu Commercial Taxes Department.
GST for Software Exporters in Thoraipakkam
An export invoice is only the beginning; the law tests whether each supply meets every condition of Section 2(6) of the IGST Act, and Rule 96A adds a deadline: payment for exported services must be realised within one year, failing which the tax skipped under your undertaking becomes payable with interest. That makes an invoice-wise FIRC trail essential, mapping each foreign remittance to specific export invoices rather than lumping receipts together. Contracts between an Indian subsidiary and its overseas parent need careful drafting so the two are treated as distinct persons. A specialist builds the realisation register and remittance mapping that keeps zero-rating defensible year after year.
Businesses in Thoraipakkam typically choose professional GST Notice Reply because reconciled, senior-reviewed filings from Rs.2,999 prevent the late fees, lost credit and mismatch notices that self-filing commonly produces.
Why Us

Why Eshwaran Koil Street, Thoraipakkam Businesses Choose ChennaiGST

Not a bulk-filing portal. A senior consultant knows your file, your jurisdiction and your deadlines.

Deadline Tracking Done for You

GSTR-1 by the 11th, GSTR-3B by the 20th, CMP-08 by the 18th after each quarter — we maintain a compliance calendar for every client and start chasing your data well before the due date, so late fees never enter the picture.

Extra Hands During Filing Windows

In the days before the 11th and the 20th, our team runs extended hours and a strict internal queue, so a client who sends data late in the window is still filed on time. Peak-season crush at our end never becomes a late fee at yours.

A Real Local Office You Can Walk Into

We are a Chennai firm with a physical office, not a faceless portal. If you prefer to sit across a table with your papers, you are welcome. Clients from Thoraipakkam regularly visit us for registrations, notice discussions and annual return reviews.

Advisory, Not Just Data Entry

We tell you when the composition scheme stops making sense, when QRMP suits your cash flow, and when a supplier's non-compliance is quietly costing you credit. Filing is the minimum; helping you make better GST decisions is the actual job.

E-Invoice and E-Way Bill Fluency

E-invoicing is mandatory once turnover crosses Rs.5 crore and e-way bills apply to goods movements above Rs.50,000. We set up, train and troubleshoot both systems, so your despatches from Thoraipakkam are never held up by a compliance gap at the gate.

Waiver and Amnesty Windows Applied for You

Whenever the GST Council notifies a late-fee waiver or an amnesty window for pending returns or old demands, we check every client's history against it and act within the deadline. Relief that businesses in Thoraipakkam would otherwise read about after it lapsed reaches our clients in time.

How It Works

Our Notice Reply Process

Notice study

We read the notice line by line, identify the section invoked, the periods covered, the exact information sought and the deadline for response.

Data reconciliation

The figures alleged in the notice are reconciled against your filed returns, GSTR-2B and books, so the reply is grounded in verifiable numbers rather than assertions.

Reply drafting

We draft a professional, point-wise reply addressing every allegation, attaching reconciliations, invoices and legal support, and share the draft with you for approval.

Filing and payment

The approved reply is filed on the portal within the deadline. Where a small genuine liability exists, we advise payment through DRC-03 to limit interest and penalty.

Closure tracking

We monitor the portal for the officer's response, attend to any further queries or hearing dates, and pursue the matter until a closure or order is received.

Outcomes

What You Get

Practical outcomes our clients measure us by.

Marketplace Accounts That Stay Live

E-commerce platforms continuously validate seller GSTINs and filing status. A consistently compliant registration keeps your listings active and settlements flowing, with no sudden suspension of your online sales channel.

Peace of Mind Around Due Dates

The 11th and the 20th stop being days of dread. You approve a prepared draft, we file, and the acknowledgement lands on your WhatsApp — month after month, without drama.

Bank and Tender Readiness

Loan applications and government tenders routinely demand GST returns and registration documents. With everything filed and archived properly, you can produce a complete compliance file within hours instead of days.

Annual Returns Without the Year-End Scramble

Because monthly data is reconciled as it happens, GSTR-9 preparation before the 31 December due date becomes a review exercise rather than a painful reconstruction of twelve untidy months.

Due-Diligence Ready for Investors and Buyers

Funding rounds, partnerships and business sales all begin with a compliance check. A clean, documented GST history lets you clear that scrutiny quickly instead of watching a deal stall over old filing gaps.

Tax Paid Under the Right Head

Getting IGST versus CGST and SGST right at the invoice stage spares you the painful cycle of paying the correct head again and pursuing a refund of the amount paid under the wrong one.

Why a Specialist Matters

With ChennaiGST vs Doing It Yourself

AspectWith ChennaiGSTDIY / Unattended
Time costRoughly an hour a month to send data and approve drafts; the portal work, reconciliation and follow-up are ours.Hours every month lost to portal errors, JSON files, OTP failures and reworking figures — usually on the due date itself.
When a notice arrivesA professional drafts the reply in the department's format and files it within the statutory window, such as thirty days for ASMT-11.You face departmental language alone, and a missed reply deadline can convert a simple query into a demand with penalty.
Annual return preparationMonthly reconciliations roll naturally into GSTR-9, filed comfortably before 31 December with figures already agreed through the year.Twelve months of unmatched data reconstructed in December, with differences discovered too late to be corrected cleanly.
Goods in transitE-way bills generated correctly and matched to invoices, so consignments pass roadside inspections without detention or penalty.A defective or missing e-way bill can mean detention at a checkpoint, with penalties that dwarf the tax on the consignment.
Due-date trackingA maintained compliance calendar with internal cut-offs days before the 11th and the 20th; we chase you for data, not the other way around.Deadlines remembered from memory or phone alarms; one busy week and the return slips past the due date.
Late fees and interestFilings go in ahead of statutory dates, so the Rs.50-per-day late fee and 18 percent interest never arise.Late fees accumulate silently every delayed day, and interest on unpaid tax runs at 18 percent per annum.

Portal Advisory

Officers must give written grounds of arrest before arresting under GST

CBIC Instruction No. 01/2025-GST · 2025-01-13

Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.

Practical effect: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.

AAR Ruling

Agricultural seedling trays are plastic articles taxable at 18 percent

Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

How we apply it: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

Case Law

Madras High Court restricts Central authorities from proceeding against State-assigned taxpayers without cross-empowerment notification

Tvl. Vardhan Infrastructure v. Special Secretary — Madras High Court, 2024 · 2024-03-11

The Madras High Court examined the administrative division of taxpayers between Central and State GST authorities and held that, in the absence of a notification providing for cross-empowerment, the counterpart administration cannot initiate proceedings against a taxpayer assigned to the other authority. The statutory framework on cross-empowerment operates as a safeguard against parallel and overlapping action, and proceedings initiated by the wrong administration are without jurisdiction. The ruling is widely cited in jurisdictional challenges.

What to do about it: Check which administration your GSTIN is assigned to — a notice from the other wing can be challenged on jurisdiction, though verify the current appellate status before relying solely on this ground.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

What documents are required for GST notice reply in Thoraipakkam?
For GST notice reply you will generally need: Copy of the notice received, with its reference number and date, GST portal login credentials, GSTR-1 and GSTR-3B filed copies for the periods in question, GSTR-2A and GSTR-2B data for the relevant periods, Sales and purchase registers for the periods covered. The exact list depends on your constitution — proprietorship, partnership, LLP or company — and on the specifics of your case. Send what you have on WhatsApp to +91 - 9600 606 444 and we will confirm within the same working day exactly what else is needed, so nothing is rejected later for a missing paper.
Which GST office handles Thoraipakkam businesses?
Businesses in Thoraipakkam (PIN 600097) generally fall under the CGST Chennai South Commissionerate, with state-jurisdiction cases handled by the Tamil Nadu Commercial Taxes Department. Your exact division and range can be confirmed from your GSTIN on the GST portal. We regularly appear before this jurisdiction for registrations, clarifications and hearings, so we know the local practice and documentation preferences.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in Thoraipakkam have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Thoraipakkam as urgent.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. We advise Thoraipakkam businesses to check both tabs at least once a month, because a reply deadline starts running from the date of issue on the portal, not from when you happen to see it.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. File within the time allowed in the notice. ChennaiGST drafts DRC-06 replies for Thoraipakkam businesses with a hearing strategy built in from the start.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. Treat the draft objection stage seriously; a strong rebuttal there often prevents a show cause notice altogether.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a Thoraipakkam seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.
Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Litigation-heavy businesses in Thoraipakkam should reconcile their legal expense ledger against RCM paid every quarter.
The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. So goods delivered in Thoraipakkam before 22 September 2025 but invoiced and paid for afterwards attract the new rate, while goods delivered and invoiced earlier keep the old rate even if payment came later. Document dates carefully during any transition window, because officers test these invoices in scrutiny.
How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. Apparel, made-up textile articles and footwear with a sale value up to Rs.2,500 per piece attract 5 percent GST, while pieces priced above Rs.2,500 attract 18 percent. The test applies item by item, so a single invoice from a garment shop in Thoraipakkam can carry both rates: a Rs.1,800 shirt at 5 percent and a Rs.4,000 pair of shoes at 18 percent on the same bill. Configure the billing software to test the price of each line item automatically rather than applying one blanket rate.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. ChennaiGST ensures clients in Thoraipakkam never face this complaint.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Thoraipakkam architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
What is the process for GST notice reply?
The process runs in clear stages: Notice study; Data reconciliation; Reply drafting; Filing and payment. A senior consultant reviews your file at each stage rather than passing it to a data-entry desk, and you receive a confirmation with the filed documents once it is complete. You always know which stage your work is at — we update you on WhatsApp instead of leaving you to follow up.
Are there any hidden charges for GST notice reply?
No. The fee quoted before we start is the fee you pay. Government fees, portal charges or statutory late fees, where they apply, are separate and disclosed to you in advance with the exact amount. We issue a proper GST invoice for our professional fee. If the scope of work changes — for example, an unexpected notice or additional periods — we tell you the revised fee before doing anything further.
Do you provide gst notice reply for small businesses and proprietorships in Thoraipakkam?
Yes. A large share of our clients in Thoraipakkam are proprietors, small traders, shop owners, freelancers and family businesses rather than large companies. The fee of Rs.2,999 and the process are the same regardless of size, and we explain the compliance position in plain language — in Tamil or English — so you understand what is being filed on your behalf and why.
