No second levy of IGST when goods leave a Free Trade Warehousing Zone

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. So credit on a March 2026 invoice must be taken in a GSTR-3B filed on or before 30 November 2026. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Thoraipakkam.

I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
What is the default place of supply rule for services within India?
Section 12(2) of the IGST Act sets the general rule for domestic services: if the recipient is registered, the place of supply is the recipient's location; if unregistered, it is the recipient's address on your records, and failing that, the supplier's own location.
