The applicant bought used gold ornaments from individuals who were not registered under GST and resold them after cleaning and polishing, without altering the nature of the goods. The Karnataka Authority for Advance Ruling held that the margin scheme in Rule 32(5) of the CGST Rules applies, so GST is payable only on the difference between the selling price and the purchase price. Since the seller is unregistered, no input tax credit arises on the purchase, and the value is nil where the margin is negative.

A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
