GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.

Practical effect: Download and store PDF and JSON copies of every GSTR-1, GSTR-3B and GSTR-9 filed since 2017, because archived returns cannot be retrieved from the portal during an audit or appeal.

Compensation cess reduced to nil on almost all goods

Notification No. 2/2025-Compensation Cess (Rate), dated 17 September 2025 · 2025-09-17

Alongside the new rate schedules, this notification amends the 2017 compensation cess rate notification to bring the cess down to nil on nearly every entry with effect from 22 September 2025, because the goods that had carried cess were absorbed into the new eighteen and forty per cent rates. Only pan masala, tobacco and related products continued to carry cess after that date, pending discharge of the compensation loan obligations.

Circular No. 164/20/2021-GST dated 06.10.2021 · 2021-10-06

This circular settled several long-running food service disputes. It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.

What to do about it: A Chennai cloud kitchen bills at 5 per cent without credit, but an ice cream parlour selling tubs and cones must charge the goods rate and can keep its credits.

What is the difference between GST return scrutiny and a departmental audit?

Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. What are the exact steps to file a DRC-03 voluntary payment on the GST portal?
Log in and go to Services, then User Services, then My Applications, choose Intimation of Voluntary Payment DRC-03 and click New Application. How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment. Following amendments, interest on delayed GSTR-3B liability applies on the portion paid through the electronic cash ledger, and interest on wrongly availed ITC arises where the credit has been both availed and utilised. Interest is payable even where no penalty applies, and it cannot be waived by the officer. Because interest compounds silently over long disputes, paying the admitted tax early through DRC-03, even while contesting the rest, often saves a substantial amount.
The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
