Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

After an October 2024 advisory and a January 2025 deferment, GSTN confirmed that from the July 2025 tax period the auto-populated outward tax liability in GSTR-3B, drawn from GSTR-1, IFF or GSTR-1A, is hard-locked and cannot be edited manually while filing. Any correction to sales figures must be made through GSTR-1A before GSTR-3B is filed. The change is intended to end mismatches between GSTR-1 and GSTR-3B.

The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.

Practical effect: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.

What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
What happens if I miss filing GSTR-3B this month?
A late fee of Rs.50 per day (Rs.20 per day for a nil return) accrues automatically, capped based on your turnover, and interest at 18 percent per annum applies on tax paid late. You also cannot file the next period's GSTR-1 until the pending GSTR-3B is filed, since returns must be filed sequentially. If two consecutive tax periods remain unfiled, e-way bill generation gets blocked, and continued default can lead to suspension of your GSTIN. Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. Companies in Thoraipakkam should route CSR procurement through a separate expense code so their monthly reconciliation automatically excludes these invoices from the ITC claim.

Who has to file the GSTR-9 annual return?
GSTR-9 is the annual return for regular taxpayers, consolidating the outward supplies, input tax credit and tax paid reported through the year's GSTR-1 and GSTR-3B filings. As per CBIC notifications, filing is optional for taxpayers with aggregate turnover up to Rs.2 crore for the relevant financial year, and mandatory above that. Composition taxpayers file GSTR-4 instead, and e-commerce operators collecting TCS under Section 52 file GSTR-9B. What is the GST treatment for an event management company handling corporate events?
Event management services attract 18 percent with full input tax credit. Place of supply rules deserve attention: for organising an event for a registered client, the place of supply is the client's location, so a Chennai company organising a Goa offsite for a Bengaluru-registered client charges IGST to Karnataka. For unregistered clients, the place of supply is where the event is actually held. Admission tickets are taxed where the event takes place. Getting the state wrong means the client's credit is jeopardised and the tax may need repayment under the correct head, so event companies serving multi-state clients should map each contract before invoicing.
Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh.
