My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. Why is the portal not letting me file GSTR-1?

How and when can I opt in or out of the QRMP scheme?
The option is exercised on the GST portal under Services, Returns, Opt-in for Quarterly Return. The window for any quarter runs from the first day of the second month of the preceding quarter to the last day of the first month of the quarter you are opting for. For example, to be under QRMP for July to September, opt in between 1 May and 31 July. Once chosen, the option continues for future quarters until you change it or your turnover crosses Rs.5 crore. My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. What counts as exempt supply when calculating my ITC reversal ratio?

The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. How do I round off tax amounts on a GST invoice?

By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Thoraipakkam godown without an invoice is exposed to detention even if the e-way bill exists.
