GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.
Practical effect: If you settled 2017-20 demands under the amnesty, preserve the SPL filings and payment proofs; if you missed it, factor full interest into dispute strategy.
Entry 4, Notification No. 13/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
Sponsorship services supplied by any person to a body corporate or partnership firm located in the taxable territory were placed under reverse charge, so the sponsor paying for naming rights, event branding or team sponsorship had to discharge the tax. The entry has since been narrowed: on the recommendation of the GST Council at its 55th meeting, sponsorship services supplied by body corporates were moved to forward charge, leaving reverse charge to apply mainly where the sponsorship provider is not a body corporate.
Practical effect: A Chennai company sponsoring a sports event or cultural programme must check whether the organiser is a body corporate before deciding to pay under reverse charge or accept a tax-charged invoice.

Following the 56th GST Council meeting, CBIC clarified the treatment of secondary and post-sale discounts. Where a supplier issues a financial or commercial credit note without adjusting GST, the dealer need not reverse input tax credit, since the tax originally charged stands unchanged. Discounts given to dealers are not consideration for any service by the dealer merely because they aid sales, unless a specific agreement obliges the dealer to perform defined promotional activities for separate consideration.
What it means for you: Distributors receiving commercial credit notes can retain full ITC, and demands seeking reversal or treating routine trade discounts as marketing services should be contested with this circular.
