Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.
Why this matters: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.
34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
What to do about it: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.

The Supreme Court disapproved of High Courts ordering interim release of goods seized in transit on terms different from those prescribed in Section 129 CGST Act and Rule 140. It held that the statute provides a complete mechanism for release — payment of tax and penalty or furnishing security or bond — and taxpayers must follow that route before the competent authority rather than obtaining ad hoc relief in writ petitions.
