CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

The Supreme Court held that the burden of proving wilful suppression or misstatement lies squarely on the revenue and cannot be discharged by mere assertion. Something positive, beyond simple inaction or failure, must be shown. A bona fide belief formed on the basis of legal advice or industry practice negates the charge. The extended period is an exception and must be applied strictly.

Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.
What it means for you: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.
