For a whole-time or executive director, the part declared as salary and on which tax is deducted under section 192 of the Income-tax Act is treated as consideration in the course of employment and is outside GST, while the part treated as professional fees with deduction under section 194J is taxable under reverse charge.

The Council decided that all taxpayers would file GSTR-3B with payment of tax by the 20th of the succeeding month until March 2018, and that for GSTR-1 taxpayers would be divided by turnover. Those with annual aggregate turnover up to Rs 1.5 crore would file GSTR-1 quarterly, and those above that figure monthly, with a detailed table of due dates. Filing of GSTR-1 was to continue without requiring GSTR-2 and GSTR-3 for the previous period.

Goods transport agencies given the option to pay tax under forward charge

Annexure V to Notification No. 11/2017-Central Tax (Rate), inserted by Notification No. 03/2022-Central Tax (Rate) dated 13.07.2022 with effect from 18 July 2022 · 2022-07-13

From 18 July 2022 a goods transport agency may choose to pay tax itself instead of leaving it to the recipient under reverse charge. The option is exercised by filing a declaration in Annexure V with the jurisdictional officer before the financial year begins. Having opted in, the transporter charges tax on its own invoices, either at 5 per cent without input tax credit or at 12 per cent with full credit, and the recipient must not pay reverse charge on those bills.

Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Report the taxable value and tax in Table 3.1(d) of GSTR-3B; this liability must be discharged in cash through the electronic cash ledger, because input tax credit cannot be used to pay reverse charge dues. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. What is the default place of supply rule for services within India?

Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Tiruvottiyur buying stationery from an unregistered shop has no Section 9(4) liability at all.
