The Supreme Court held that credit validly earned on inputs already received and used becomes a vested right of the manufacturer. A rule that sought to lapse such accumulated credit was struck down as it operated to take away a right that had already accrued, without any corresponding change in the underlying transaction. Rights that have crystallised cannot be extinguished by a subsequent rule operating retrospectively.
What to do about it: Where a Chennai business has validly earned input tax credit, it can resist any attempt to lapse that credit through a later procedural change.

Specified goods supplied to holders of petroleum exploration licences, mining leases and coal-bed methane contracts had enjoyed a concessional rate of five per cent under Notification No. 3/2017-Central Tax (Rate) subject to certificate conditions. This notification raised that concessional rate to twelve per cent with effect from 18 July 2022, following the Council's decision to trim rate concessions that were creating credit accumulation. The certificate and end-use conditions of the parent notification continued unchanged.
What it means for you: Suppliers of equipment to oil and gas operators must obtain the prescribed certificate before applying the concessional rate, and must apply the rate in force on the date of supply.

The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. Other classification and exemption questions on specified services were also settled, so that field formations across States adopt a uniform view rather than issuing conflicting demands.
