GSTN Advisory, November 2024 — Form GST DRC-03A functionality on the portal (Rule 142(2B) and Notification No. 12/2024-Central Tax, dated 10 July 2024) · 2024-11
Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.

Notification No. 16/2021-Central Tax · 2021-06-01
This notification brought into force Section 112 of the Finance Act, 2021, which substituted the proviso to Section 50(1) of the CGST Act with retrospective effect from 1 July 2017. The result is that interest on late payment of tax through a delayed GSTR-3B is chargeable only on the portion discharged in cash, for all periods from the inception of GST, and not merely from September 2020. This ended the large body of litigation over gross-liability interest demands.
Practical effect: Every interest demand computed on gross liability for any period since July 2017 is unsustainable, and this is one of the most useful notifications to cite in a Chennai interest dispute.
Agarwal Foundries (P) Ltd v. Union of India — Telangana High Court, judgment dated 6 November 2020 · 2020-11-06
The petitioners alleged assault during a GST enquiry, supported by a hospital record of a blunt injury. The High Court held that tax officers, conducting what are administrative and not criminal proceedings, have no authority to use violence, and that freedom from torture is part of Article 21. It restrained any use of force, confined questioning to weekdays between 10.30 a.m. and 5.00 p.m., permitted counsel to be present within visible but not audible distance, and moved the enquiry away from the officer concerned.
What to do about it: During a summons or search you are entitled to civil treatment, reasonable hours and the presence of your advisor within sight — insist on it and record any breach at once.
