The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.
What to do about it: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.
GSTN Advisory — Invoice Management System, live from 14 October 2024 · 2024-10-14
GSTN launched the Invoice Management System (IMS) on the portal from 14 October 2024. Buyers can now view each invoice uploaded by suppliers in GSTR-1, IFF or GSTR-1A and mark it as accepted, rejected or pending. These actions determine what flows into GSTR-2B, with the first IMS-based GSTR-2B generated on 14 November 2024 for the October 2024 period. Records left without action are treated as deemed accepted.
What to do about it: Set up a monthly IMS review before your GSTR-2B is generated so wrong or fraudulent supplier invoices do not silently enter your ITC.
TVH Lumbini Square Owners Association - AAR Tamil Nadu, Order No. 25/ARA/2019, dated 21 June 2019 · 2019-06-21
A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
