The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.
Practical effect: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

Goods moved under a valid e-way bill which the purchaser cancelled without informing the seller. The goods were seized and penalty imposed under Section 129(3). Relying on the Supreme Court's decision in Satyam Shivam Papers, the High Court quashed the penalty and the appellate order, holding that intent to evade tax is mandatory for invoking Sections 129 and 130. Where the breach is minor and unintentional, the department should have proceeded, if at all, under Section 122.
Why this matters: A cancellation or defect caused by your customer, of which you had no notice, is a strong defence against a Section 129 penalty.

The residential rent reverse charge as first drafted caught every registered person, including a proprietor who held a GST number for his trading business but was simply renting a house for his family. A proviso was inserted to say that the reverse charge does not apply where the dwelling is rented to a registered person who is a proprietor of a proprietorship concern and rents it in his personal capacity as his own residence, on his own account. The relief operates from 1 January 2023.
Why this matters: A Chennai proprietor renting his own family home need not pay GST on the rent, but should keep the lease deed in his personal name to prove the point.
