The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.
Why this matters: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

Acting on complaints of forced recoveries during GST searches, the Gujarat High Court directed CBIC to issue guidelines that no recovery of tax should be made at the time of search, inspection or investigation under any circumstances, and that even a taxpayer wishing to pay voluntarily should be advised to file DRC-03 only after the search ends. These directions led to CBIC Instruction No. 01/2022-23 (GST-Investigation) deprecating coercive collection during searches.

Notification No. 13/2022-Central Tax · 2022-07-05
Acting under Section 168A, CBIC extended the time limit for issuing orders under Section 73 in respect of the financial year 2017-18 to 30 September 2023. It also directed that the period from 1 March 2020 to 28 February 2022 be excluded when computing the limitation for issuing a demand order for an erroneous refund, and when computing the two-year period for filing a refund application under Section 54 or Section 55. The exclusion applies automatically and does not require any application.
Why this matters: A Chennai exporter whose refund claim looks time-barred should recompute after excluding two full COVID years, as many apparently dead claims are in fact still alive.
