Swiggy's parent, Bundl Technologies, paid large sums at odd hours during a DGGI investigation into alleged wrongful ITC and contended the payments were made under threat of arrest. The Karnataka High Court held that collection of tax during investigation without assessment or self-ascertainment offends Article 265, found the payments involuntary in the circumstances, and directed the department to consider refund; a Division Bench affirmed the taxpayer-protective reasoning on threat and coercion.

The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
I applied for GST registration in Vadapalani and received a REG-03 notice. What does it mean?
Form REG-03 is a notice seeking clarification on your GST registration application. How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Vadapalani businesses, since no appeal is provided against DRC-22. What is the general penalty under Section 125 and when is it imposed?

Pay the portion you accept through Form DRC-03 with interest at 18 percent per annum, and in your ASMT-11 reply state the payment details along with a reasoned explanation for the balance, supported by reconciliations, invoices and ledger extracts. Paying the admitted amount voluntarily at the scrutiny stage avoids penalty on it under Section 73 and shows bona fides, which helps the officer accept your explanation on the disputed part. How often should I get a GST health check done for my business?

DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
My customer in Mumbai asked me to deliver goods directly to his buyer in Vadapalani. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. So you invoice the Mumbai customer with IGST even though the goods physically moved within Tamil Nadu, and the Mumbai customer raises a second invoice on the ultimate recipient in Vadapalani. Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025.
