A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
Practical effect: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

Following the Supreme Court directions in Union of India versus Filco Trade Centre, the Board issued guidelines allowing every aggrieved taxpayer to file or revise FORM GST TRAN-1 and TRAN-2 on the common portal during a special window from 1 October 2022 to 30 November 2022. The circular set out the declaration to be filed, the requirement to submit a self-certified copy to the jurisdictional officer, and the verification timelines that follow the filing.
Why this matters: Transitional credit disputes from 2017 that reached the courts were routed through this one-time window, and any pending verification of a Chennai taxpayer's TRAN filing is governed by these guidelines.

Solar and other renewable energy projects are usually supplied as a single turnkey contract covering panels, structures, cabling, erection and commissioning, which led to endless disputes on whether the concessional goods rate or the higher works contract rate applied. From 1 January 2019 the law deemed seventy per cent of the gross consideration to be the value of goods, taxed at the concessional renewable energy rate, and thirty per cent to be the value of the taxable service.
